Non-Enforcement Period for FFCRA ended April 18, 2020

As the the Department of Labor (DOL) is now enforcing the new requirements of the Families First Coronavirus Response Act (FFCRA), it is critical that you check your internal policy and guidelines in order to ensure that you are in compliance with the new requirements.


The Department of Labor had indicated that it would not bring enforcement actions against any public or private employer for violations of the Families First Coronavirus Response Act (FFCRA) occurring within 30 days of the enactment of the FFCRA, i.e. March 18 through April 17, 2020. DOL provided that during the non enforcement timelines, the employer was to make reasonable, good faith efforts to comply with the Act.


After April 17, 2020, the temporary stay of enforcement was lifted. DOL will fully enforce violations of the FFCRA. As such, all affected employers are to ensure they are meeting their new obligations under the new Act.
